Under what legislation is the claim undertaken?

Your claim will be pursued using the normal principles of UK law.

The legislation entitling you to bring the claim in the UK is the Civil Jurisdiction and Judgment Order 2001 as amended by the Civil Jurisdiction and Judgments Regulation 2007.

Boring we know but just to be completely accurate these regulations were brought in by the UK government because they were obliged to under the the fifth Motor Insurance Directive (Directive 2005/14/EC) which had to be transposed into the national laws of all member states. It strengthens claimants’ rights introduced by the fourth directive (2000/26/EC).
