Northern Ireland driver has accident in the Irish Republic: can he be compelled to use the Irish Republic's Personal Injuries Assessment Board
I am from Northern Ireland and was involved in a head on crash with another car on a narrow lane during a recent trip across the border in the Irish Republic. The guards who attended the scene measured up and said the other man had been speeding whereas my skidmarks showed I had not. The man's insurers in the Irish Republic have conceded liability but are insisting the claim is processed through the Personal Injuries Assessment Board in the Irish Republic and won't speak to my solicitor. Is it true I can now bring the claim with you in Northern Ireland or elsewhere in the UK?
You have a choice of jurisdiction.
You are entitled to pursue the claim with Solicitors in Northern Ireland and cannot be forced to use the PIAB. If you are domiciled in Northern Ireland then you should insist on your chosen jurisdiction. The insurer in the Irish Republic cannot compel you to use the PIAB and claims made through the PIAB are routinely settled at a lower figure than those achieved in the six counties of Northern Ireland.
You will almost certainly be better off bringing your claim in Northern Ireland.
