Italian working in London had a road accident resulting in injury on holiday in Italy: what is the best location to bring a compensation claim?
I am an Italian working for an American bank in London. I pay tax in the UK. Recently on holiday back in Italy I was involved in an accident where a car ran into me from behind. Both my wife and I suffered (and continue to suffer) whiplash injuries. Can you advise whether as UK taxpayers we would be able to claim compensation for our injuries in the UK even though we are Italian nationals as I understand the compensation payouts are higher here.
You probably have the choice of a claim in Italy or the UK. You are correct that UK damages are likely to exceed Italian damages and the claim will almost certainly be dealt with more quickly by the English courts.
Whether you can bring the claim in th UK depends upon your domicile. Whilst payment of tax in the UK is a likley indicator of UK domicile it is not definitive.
